Settlement Agreement Social Media Clause

These cover the admissibility of the settlement offer in a court case. Often, a conversation about an offer is not “protected or without prejudice,” even if it is labeled as such. Confidentiality and non-vaccination clauses are common in settlement agreements and termination contracts in the context of labor law. Today, however, the temptation for angry former employees to destroy their former employer on social media sites such as Facebook, Twitter or LinkedIn, on blogs, by text or email or other electronic means can be irresistible. Since proving damages for breach of confidentiality tends to be difficult, concordation agreements can set out remedies such as lump sum reimbursement of financial damages, rights of omission, attorneys` fees and/or attorneys` fees.
