Your rights In PES, we are your contract experts and every day we defend the rights of workers classified in the workplace. Collective bargaining In simple terms, collective bargaining is the two-way process between an employer (your school district or university) and a union. This process determines everything from wages and health care to hours and working conditions. The end result of collective bargaining is a legally binding contract that clearly describes workers` rights and benefits. Today, some chapters of the PES are trying new ways of negotiating. Interest-based negotiations are an approach to collective bargaining. It focuses on problem-solving rather than defending “hard” contradictory positions. Conflicts of interest are a trust-based system, but not all chapters enjoy the same position or positive working relationship with management. PES Legal Counsel employs union lawyers to assist in the negotiation and enforcement of collective agreements. The enforcement measures will be implemented in accordance with the appeal procedure described in your contract. If a complaint is not resolved at a lower stage, a PES lawyer can help you bring your complaint to an arbitration tribunal or higher court.
